Plan for the future

The importance of making your wishes known cannot be overstated. Create a plan for transferring your assets both during life and upon death. Avoid the expense and delay created by a probate or administration proceeding. Avoid negative estate, gift, income, and capital gains tax consequences.

Appoint a guardian for your minor child. Appoint someone to manage your financial affairs when you are no longer able to do so. Appoint someone to make health care decisions for you when you are no longer able to do so. Make your wishes known regarding life-sustaining treatment.

Plan for long-term care

Long-term care can be complicated and costly. You may qualify for Medicaid benefits that will pay for or reduce the cost of your long-term care. Medicaid Community Care can provide you with in-home personal care services. The Medicaid Chronic Care can provide you with nursing home services. Plan for eligibility using a variety of estate planning and gifting strategies. Submit an application for benefits with all requisite forms and proof.

ESTATE ADMINISTRATION

Administer the estate

Upon a person's passing, a probate or administration proceeding may be brought to appoint an Executor or Administrator to open the estate. If the person died with a will, he or she is consider to have died "testate" and a probate proceeding is requested. Conversely, if the person died without a will, he or she is considered to have died "intestate" and an administration proceeding is requested. After an Executor or Administrator is appointed and the assets have been marshaled, an accounting proceeding may brought to request a statement regarding the estate assets.

SPECIAL NEEDS PLANNING

Plan for disability

In the event you are unable to care or provide for a disabled loved one, it is important to have a plan set in place. There are a number of common issues that arise when a person with a severe chronic or persistent disability receives an inheritance. Without the proper planning, this could jeopardize your loved one's disability benefits, if any, or limit his or her access and enjoyment to the inheritance. Create a first-party or third-party supplemental needs trust.

During the estate administration process, a series of common issues may rise.  When representing the proponent of a will or trust, the attorney will argue in favor of the validity of the will. When representing the objectant, the attorney will argue that the will was a product of a lack of capacity, undue influence, improper execution, or forgery. Settle disputes through negotiations and mediation. Litigate unresolved matters before the Surrogate.
